CEMEX, S.A.B. de C.V. (NYSE: CX) has been informed today by the European Commission that it has decided to initiate formal proceedings in respect of possible anticompetitive practices in Austria, Belgium, the Czech Republic, France, Germany, Italy, Luxembourg, the Netherlands, Spain and the UK. The Commission has indicated that CEMEX, as well as seven other companies, will be included in these proceedings.
This development stems from an investigation launched by the European Commission in November 2008.
In its notification, the Commission stated that "The initiation of proceedings does not imply that the Commission has conclusive proof of the infringements but merely signifies that the Commission will deal with the case as a matter of priority."
CEMEX has cooperated with the investigation and maintains that it has always acted in accordance with applicable laws and regulations, and intends to defend its position vigorously in these proceedings.
